Pursuant to a preliminary injunction (PI) issued on March 23, 2026 (and amended on July 2, 2026), by the U.S. District Court for the Northern District of Illinois in Freedom Network, USA, et al. v. Trump et al., 1:25cv12419, ECF Nos. 90, 117), DOJ, among other things, is enjoined from requiring: “any grantee or contractor to make any “certification” or other representation pursuant to the J21 certification provision, § 3(b)(iv) of Executive Order 14173, 90 Fed. Reg. 8633 (Jan. 21, 2025)[.]” The COPS Office will comply with the PI pending further order of the court. Please note that the COPS Office is not a party to the Freedom Network litigation, and COPS Office grants are not at issue in the Freedom Network litigation.
