In Fiscal Year 2003, the COPS Office prepared an Environmental Assessment (“EA”) for the 2003 Methamphetamine Initiative1 (“Initiative”), as required by the Council on Environmental Quality’s regulations (40 C.F.R. Parts 1500 through 1508), implementing NEPA (42 U.S.C. § The Initiative provides federal funding to state and local law enforcement agencies to assist in the eradication of clandestine laboratories, specifically by providing funding assistance for the training of law enforcement personnel, the salaries and benefits of law enforcement personnel, the purchase of approved equipment and supplies, and the seizure of clandestine laboratories, including the proper removal, storage and disposal of hazardous chemical materials, equipment and other waste products retrieved from such laboratories. In Fiscal Years 2003 and 2004 the COPS Office funded and administered the Initiative. In Fiscal Year 2005, the COPS Office continues to fund and administer the Initiative. By this memorandum, the COPS Office adopts the Fiscal Year 2003 Methamphetamine EA and FONSI for the Fiscal Year 2005 Initiative. The Fiscal Year 2003 EA is current and accurate since the underlying science on which it was based has not changed. In addition, the COPS Office concludes that the Fiscal Year 2005 Methamphetamine Initiative will not constitute a major Federal action significantly affecting the environment.
